SEATTLE - The federal judge presiding over the PPA MDL denied 42 motions to remand on May 5, finding that the plaintiffs failed to state viable claims against in-state retailers. In re: Phenylpropanolamine (PPA) Products Liability Litigation, MDL No. 1407 (W.D. Wash.).
The plaintiffs sought to remand their cases to state courts in Mississippi and Louisiana, disputing that that the in-state pharmacies were fraudulently joined to the cases. The plaintiffs claim the pharmacies sold defective products and had a duty to warn them of the risk of stroke associated with PPA.
