ST. PAUL, Minn. - A district judge's award of summary judgment to Shire U.S. Inc. was upheld by the Eighth Circuit on May 18, after it found that the learned intermediary doctrine barred a couple's claim that the company failed to adequately warn about Adderall's ability to cause psychosis. Ehlis v. Shire Richwood, Inc. No. 02-3933 (8th Cir.).
The appellate court found that the district court did not abuse its discretion in its ruling because the physician who prescribed Attention Deficit Hyperactivity Disorder (ADHD) drug to Ryan P. Ehlis was aware of the drug's potential side effects.
