Supplement Maker Seeks Injunction of Ephedra Ban

SALT LAKE CITY - A Utah manufacturer is seeking an injunction of the FDA's ban on ephedra products on the ground that the agency failed to show that daily consumption of 10 milligrams or less of the herbal stimulant is associated with serious side effects. Nutraceutical Corp. et al. v. Lester Crawford, et al. No. 04-CV-409 (D. Utah).

Nutraceutical Corp. and its wholly-owned subsidiary, Solaray, argue in the May 3 lawsuit that the product contains only naturally-occurring ephedra as well as the lowest per-serving dose of ephedra compared to other supplements. The companies assert claims against the Food and Drug …
