NEW ORLEANS - The Fifth Circuit Court of Appeals dismissed without prejudice a Louisiana couple's appeal of a district judge's order denying remand, finding that the appeal did not comply with the Federal Rules of Appellate Procedure. Lyons v. Centocor Inc., et al. No. 04-30218 (5th Cir.).
On April 21, the three-judge panel granted a motion filed by Remicade manufacturers Centocor and Johnson & Johnson to dismiss Sam and Patricia Lyons' appeal on the ground that it did not comply with 28 U.S.C. § 1292(b) and Federal Rule of Appellate Procedure 5(a).
