PHILADELPHIA - A Philadelphia Court of Common Pleas judge awarded certification to a statewide class of individuals who were prescribed and ingested Baycol, are asymptomatic and seek medical monitoring. Lewis, et al. v. Bayer AG, et al. No. 010802353 (Pa. Ct. Comm. Pleas, Phila. Cty.).
In his March 19 opinion, Philadelphia County Common Pleas Court Judge Mark Bernstein refused to certify a proposed nationwide medical monitoring class, a statewide personal injury class, and a nationwide personal injury class.
