MADISON, Wis. - A Wisconsin appellate court recently affirmed summary judgment for the manufacturer of Loestrin after finding that the warnings accompanying the oral contraceptive were adequate and not the cause of a woman's blindness. Kurer, et al. v. Parke-Davis & Co., et al. No. 03-0647 (Wis. Ct. Appeal, Dist. I).
In its March 30 opinion, the First District of Wisconsin's Court of Appeals also found that Donna Kurer's submissions stating that she would have stopped using Loestrin had she received additional warnings failed to establish a negligence per se cause against the manufacturer.
