RIVERSIDE, Calif. - A California appellate court reinstated a woman's breach of warranty and deceit claims against Metabolife after finding that the allegations arose out injuries allegedly caused by her use of an ephedra-containing dietary supplement and not the company's protected commercial speech. Reynoso v. Metabolife International, Inc. No. E0322648/E032812 (Calif. Ct. Appeal, 4th Div., Dist. 2).
