Parties Agree to Dismiss with Prejudice Woman's Second Vioxx Injury Suit

CLEVELAND - A woman who twice sued Merck claiming that she suffered kidney failure as a result of using Vioxx stipulated with the manufacturer to dismiss with prejudice the claims in her second lawsuit. Rocca v. Merck & Co. Inc., et al. No. CV-04-0317(N.D. Ohio).

The case was dismissed Feb. 27, almost one month after Rose Rocca filed her second lawsuit against Vioxx manufacturer Merck in Ohio's Court of Common Pleas for Cuyahoga County on Jan. 24.

Rocca's first complaint was filed Dec. 10, 2002, and dismissed without prejudice Jan. 23, 2003.
