3 Gardasil MDL Plaintiffs Appeal Dismissal of Cases to 4th Cir.




CHARLOTTE, N.C. — Three plaintiffs in the Gardasil vaccine MDL are appealing a ruling granting Merck & Co.’s motion to dismiss their cases on the basis that they did not properly exhaust their remedies under the National Childhood Vaccine Injury Act.

Plaintiffs Tessa Needham, Shanie Roman and Angela Walker filed their notices of appeal on Aug. 29 in the 4th Circuit U.S. Court of Appeals. The appellate court consolidated the appeals on Sept. 4.
