TAMPA, Fla. - A man seeking to remand his Vioxx products liability case to state court is arguing that the sales representatives who allegedly made false representations about the drug's efficacy to his prescribing physician can be found liable under Florida law. Kozic v. Merck & Co., Inc. et al. No. 03-CV-0324 (M.D. Fla.).
Refic Kozic argues in his March 19 motion to remand that both an employer and its employee can be held liable for injuries to a plaintiff due to the employee's negligence and misrepresentations.
