NEW YORK - The federal judge presiding over the Rezulin MDL dismissed claims asserted against four Louisiana pharmacies March 16, finding that the plaintiffs failed to state a viable claim. In re: Rezulin Products Liability Litigation, MDL. No. 1348 (S.D.N.Y.).
U.S. District Judge Lewis Kaplan ruled that the court has previously held that plaintiffs cannot recover damages from pharmacies based on failure-to-warn claims and that the plaintiffs' present claims are indistinguishable from those in cases previously decided.
