HAMILTON, Ohio - The Washington Legal Foundation (WLF) filed an amicus curiae brief before the Ohio Supreme Court in opposition to a state appellate court's ruling affirming the certification of three classes of OxyContin plaintiffs. LaDonna Howland, et al. v. Purdue Pharma, L.P., et al. No. 03-1538 (Ohio Sup. Ct.).
The non-profit organization filed the brief Feb. 23, claiming that the 12th District of Ohio's Court of Appeal failed to make a meaningful distinction between Rule 23(A)'s commonality requirement and Rule 23(B)(3)'s predominance requirement when it affirmed a lower court's decision to award certification.
