NEW YORK - The federal judge presiding over the Rezulin MDL on Feb. 27granted Warner-Lambert's motion to preclude testimony from five experts regarding alleged suppression of data from the FDA as well as the ethical obligations of pharmaceutical companies. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.).
U.S. District Judge Lewis A. Kaplan held that the experts' opinions were speculative and not relevant to the underlying litigation. Judge Kaplan also found that the testimony did not satisfy Daubert's reliability requirements.
