Merck Claims Evidence Shows Plaintiff Seeking Damages in Excess of Jurisdictional Limit

TAMPA, Fla. - Merck recently removed a Vioxx-related cardiac injury case for the second time, now claiming that it has compiled enough evidence to show that the amount in controversy exceeds the jurisdictional limit of $75,000. Refic Kozic v. Merck & Co., Inc., et al. No. 04-CV-324-T-27TBM (M.D. Fla., Tampa Div.).
The manufacturer's Feb. 20 Notice of Removal states that since the case was remanded on Nov. 3, documentary evidence produced by the plaintiff demonstrated that he has already accumulated $50,000 in medical expenses and that he will be seeking recovery for future medical expenses and lost wages.
