WASHINGTON - Legal representatives for five plaintiffs involved in Zyprexa-related injury suits recently filed a response opposing manufacturer Eli Lilly's petition to have the cases transferred and centralized in the U.S. District Court for the Southern District of Indiana. In re: Zyprexa Products Liability Litigation, MDL No. 1596 (JPML).
The plaintiffs' Jan. 16 response states that the cases should not be transferred because they do not share enough common issues for consolidation since a number of the injuries or deaths were allegedly caused by either 'off label' use of the atypical antipsychotic or resulted from interactions with other drugs.
