TAMPA, Fla. — Following a defense verdict and judgment in a Florida federal electroshock therapy device case, the plaintiff is challenging an award of nearly $40,000 in costs to Somatics LLC, arguing they are “unwarranted and unreasonable” in light of the jury’s verdict and are not supported by documentation.
In an Aug. 11 motion filed before Judge Tom Barber of the U.S. District Court for the Middle District of Florida, Jeffrey Thelen further argues that the court should defer ruling on an award of costs until his Rule 59 motion is resolved, and/or any potential appeals are concluded.
