HAMILTON, Ohio - An Amicus Curiae memorandum submitted to the Ohio Supreme Court requested that the state's appellate court review its decision affirming the certification of three classes of plaintiffs who allegedly sustained injuries as a result of using OxyContin. LaDonna Howland, et al., v. Purdue Pharma, L.P., et al., No. CA2002-09-220 (Ohio Supr. Ct.).
The memorandum, filed Aug. 27 by the Washington Legal Foundation (WLF), stated that if the appellate court's decision stands, it will exacerbate the trend of filing class action claims by "encouraging efforts to certify inappropriate, unwieldy classes that render the underlying lawsuits untriable."
