La. Federal Judge Denies Plaintiff New Trial in Bard IVC Filter Case

NEW ORLEANS — A Louisiana federal judge has refused to order a new trial in a case targeting C.R. Bard Inc.’s Eclipse IVC filter, letting stand the jury’s findings that the device’s allegedly dangerous design did not cause the plaintiff’s injuries and that his surgeon was adequately warned of the risks of migration and perforation.
In an Oct. 4 order, Judge Ivan Lemelle of the U.S. District Court for the Eastern District of Louisiana found the trial was not unfair and that the court did not commit prejudicial error by refusing to admit certain of the plaintiff’s exhibits.
