Federal Judge Remands Darvon/Darvocet to California State Court

COVINGTON, Ky. — A Kentucky federal judge has remanded a Darvon/Darvocet injury case to California state court based on lack of diversity jurisdiction, ruling that the only California-based distributor defendant was not fraudulently joined. Freitas, et al. v. McKesson Corp., et al., No. 2:12-50 (E.D. Ky.).
In a July 17 order, Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky found that the claims against McKesson Corp. are not factually deficient.
