MINNEAPOLIS - Plaintiffs seeking to establish a nationwide class for individuals allegedly injured as a result of using Baycol were denied certification by a federal judge who found that individual issues predominated over common questions of fact and law. In re: Baycol Products Liability Litigation, MDL No. 1431 (D. Minn.).
In an order entered Sept. 17, U.S. District Judge Michael J. Davis ruled that the claims asserted against the manufacturer of the cholesterol-lowering drug relied on a number of individual issues including when the person used the drug, the dosage the individual received, and the nature of the injury.
