Plaintiffs' Attempt to Add Prescribing Physician to Baycol Case Denied

MINNEAPOLIS - A California couple's attempt to name the prescribing physician as a defendant to their Baycol-related injury case was rejected by a federal judge who ruled that the attempt was dilatory because the motion was submitted almost two years after the complaint was originally filed in state court. In re: Baycol Products Liability Litigation, MDL No. 1431 (D. Minn.).

U.S. District Judge Michael J. Davis' Aug. 29 decision stated that the plaintiffs would not be prejudiced by trying two cases in separate forums because they chose to file individual suits against the manufacturer and the physician.
