Judge Remands 11 Baycol Cases Involving Claims Against Prescribing Physicians

MINNEAPOLIS - A federal judge remanded 11 Baycol-related injury cases involving claims against the manufacturer as well the physicians who prescribed the drug after finding that the plaintiffs asserted viable claims against the doctors. In re: Baycol Products Liability Litigation, MDL No. 1431 (D. Minn.).
The plaintiffs sufficiently pled that the physicians contributed to their injuries by failing to follow the warnings that were provided to the public, according to U.S. District Judge Michael J. Davis' July 18 order.
Each of the plaintiffs' complaints asserted claims against Bayer, the manufacturer of the cholesterol-lowering drug, and GlaxoSmithKline, the company that helped …
