Plaintiffs’ Engineer Expert Disqualified in N.Y. Federal Stryker Hip Implant Action

NEW YORK — A New York federal magistrate judge has disqualified plaintiffs’ metallurgical and material science engineer expert in a Stryker hip implant action, because the expert had previously been retained by the defense in other, pending litigation.

In an Oct. 25 order, Magistrate Judge Steward D. Aaron of the U.S. District Court for the Southern District of New York explained that “it simply would be unfair and would subvert the integrity of the judicial process to permit the Engineer Expert to switch sides as he is seeking to do here.”
