Bayer Denies Allegations in Class Action, Asserts Class Certification Is Improper

SEATTLE - Drugmaker Bayer Corp. has filed its answer to a plaintiff's class action complaint denying all allegations and asserting, among others, an affirmative defense that no common questions of fact necessary for class certification exist. In Re Phenylpropanolamine (PPA) Products Liability Litigation, MDL No. 1407 (W.D. Wash.).

Bayer's Feb. 8 answer to the unverified complaint in Anderson, et al. v. Bayer Corp. (C01-0307R) maintains that the class set forth in the complaint cannot be maintained and that the plaintiff lacks standing.
