CHICAGO - The plaintiffs involved in the first nationwide class action filed on behalf of all consumers who purchased and consumed dietary supplements containing ephedra moved to voluntarily dismiss the suit after Illinois Governor Rod R. Blagojevich signed legislation implementing a statewide ban on the sale of products containing the herbal stimulant. Jacquelyn Castillo, et al., v. Metabolife International Inc., et al., No. 03-C-3145 (N.D. Ill.).
The June 10 motion for voluntary dismissal stated that the approval of the legislation made the plaintiffs' causes of action and request for equitable and injunctive relief moot in the state of Illinois.
