Couple Claims Belated Knowledge of Paxil Withdrawal Symptoms Tolls Statute of Limitations

TULSA, Okla. - An Oklahoma couple claims that their suit against the manufacturer of Paxil is not barred by the two-year statute of limitation because they did not become aware of the antidepressant's relationship with withdrawal symptoms until the discovery proceedings in a Wyoming wrongful death case that ended in June 2001. Candace Miller and George Miller v. GlaxoSmithKline, No. 03-CV-393K(J) (N.D. Okla., Tulsa Div.).

In addition, the statute of limitation is tolled by GlaxoSmithKline's (GSK) fraudulent concealment of the drug's ability to cause this side effect, the plaintiffs allege.
