CHICAGO - A federal judge awarded summary judgment to Eli Lilly after finding that the claims of a woman who allegedly sustained injuries as a result of in utero exposure to DES were barred by the statute of limitations. Katherine M. Albers and James G. Albers v. Eli Lilly & Co., No. 02-C-884 (N.D. Ill., Eastern Division).
Senior United States District Judge Milton I. Shadur's April 15 order stated that plaintiff Katherine Albers failed to exercise reasonable diligence by not inquiring whether her mother's exposure to DES caused her alleged injuries for eight years following her diagnosis.
