NEW YORK - A federal judge agreed to remand medical malpractice claims asserted by a plaintiff who alleged that his physician failed to diagnose a liver injury caused by the ingestion of Rezulin. In re: Rezulin Products Liability Litigation, MDL No. 1348 (S.D.N.Y.).
U.S. District Judge Lewis A. Kaplan's June 2 order denied the motion to remand the entire case and stated that the doctor should be dropped as a defendant in the plaintiff's suit against the drug maker.
