MINNEAPOLIS - A motion to remand a Baycol suit has been granted after a federal judge determined that the plaintiff could recover damages for injuries stemming from concomitant use of Baycol and gemfibrozil because the pharmacy that dispensed the drugs had a duty to warn of potentially dangerous drug-drug interactions. In re: Baycol Products Liability Litigation, MDL No. 1431 (D. Minn.).
U.S. District Judge Michael J. Davis' order also denied a second plaintiff's motion to remand on the ground that the pharmacy does not have a duty to warn consumers of a drug's potential side effects.
