CHICAGO — An Illinois federal judge has refused to reinstate a lawsuit accusing Smith & Nephew and Zimmer of defectively designing and manufacturing artificial knee components, ruling that the plaintiff failed to identify any new allegations suggesting that she could cure the deficiencies in her second amended complaint.
In an Oct. 7 ruling, Judge Sharon Coleman of the U.S. District Court for the Northern District of Illinois further found the defendants would be prejudiced if the case were reinstated, given the plaintiff’s failure to timely inform the court that she wished to file a third amended complaint.
