Taxotere Bellwether Plaintiff Seeks New Trial in Wake of Defense Verdict

NEW ORLEANS — The plaintiff in the first Taxotere permanent hair loss case to go before a jury has asked a Louisiana federal judge for a new trial, arguing that the defense verdict was erroneously based upon the unreliable testimony of defendants’ corporate expert.

In an Oct. 25 motion filed before Judge Jane Triche Milazzo of the U.S. District Court for the Eastern District of Louisiana, plaintiff Barbara Earnest argued that the testimony of defense expert Dr. Michael Kopreski should have been excluded because it was based upon data that was cherry-picked by defense counsel.
