ATLANTA — A federal appellate court has upheld a $2.4 million judgment issued in a case involving Mentor’s ObTape Transobturator polypropylene mesh sling, ruling that the trial court did not err in allowing the presentation of certain expert testimony to the jury.

In an Oct. 8 opinion, the 11th Circuit U.S. Court of Appeals further found that the jury’s award of punitive damages to the plaintiff was supported by evidence that Mentor “was grossly negligent with regard to the risks of ObTape – both its porosity and its propensity to degrade.”
