Manufacturing Defect Claim Survives Dismissal Motion in Wright Hip Action

MINNEAPOLIS — A Minnesota federal judge has denied Wright Medical Technology’s motion to dismiss a strict liability manufacturing defect claim in a hip replacement action, ruling that the plaintiff adequately alleged that the components she received differed from the intended design.

In an Oct. 2 order, Judge Eric C. Tostrud of the U.S. District Court for the District of Minnesota added that at this stage, the plaintiff is not required to identify a particular flaw in the manufacturing process.
