Judge Allows Plaintiff in Gadolinium-Based Contrast Agent Case to Amend Complaint

BOSTON — A Massachusetts federal judge has allowed a plaintiff to amend his complaint in a lawsuit targeting Bayer’s gadolinium-based contrast agent (GBCA), after ruling that the complaint is preempted because it did not cite any newly acquired information that would have allowed Bayer to change its label.

In a Sept. 30 order, Judge Indira Talwani of the U.S. District Court for the District of Massachusetts further ruled that the plaintiff adequately pled that Magnevist caused his injuries.
