Remicade Neuropathy Claims Time-Barred, Ala. High Court Affirms

MOBILE, Ala. — Claims that Remicade caused a man’s neuropathy are time-barred because he failed to show how Janssen Biotech Inc.’s allegedly fraudulent acts prevented him from discovering the cause of his injury sooner, the Alabama Supreme Court has ruled.

In a Sept. 27 order, the court further found the trial court properly struck the plaintiff’s initial complaint, which was filed five months earlier, because it was not signed as required by Alabama law and contained substantial errors and misstatements of fact and law.

Alabama resident Tim McKenzie was prescribed Remicade in July 2012 to treat his psoriatic arthritis. …
