MINNEAPOLIS — Plaintiffs plan to appeal a Minnesota federal judge’s award of summary judgment to 3M on claims that the Bair Hugger Warming Devices can cause periprosthetic joint infection (PJI), according to a recent filing on the multidistrict litigation docket.
The notice of appeal to the 8th Circuit U.S. Court of Appeals was filed on Sept. 5. Plaintiffs will challenge an Aug. 1 ruling in which Judge Joan N. Ericksen of the U.S. District Court for the District of Minnesota effectively closed the MDL docket after finding plaintiffs failed to prove causation.
