ORLANDO - A federal judge remanded a statewide putative class action suit filed against the manufacturer of OxyContin after finding that the drug maker did not prove the cost of the requested medical monitoring program would exceed the jurisdictional limit of $75,000. Alan Jackson, et al., v. Purdue Pharma, L.P., et al., No. 02-CV-1428-Orl-19KRS (M.D. Fla., Orlando Div.).
U.S. District Judge Patricia C. Fawsett's April 10 order also says that Purdue Pharma, the manufacturer of the drug, failed to show that the plaintiff's state law claims under the Food, Drug & Cosmetic Act (FDCA) raised a federal question.
