Pa. Appellate Court Upholds Plaintiff’s Verdict in Ethicon Transvaginal Mesh Case

HARRISBURG, Pa. — A state appellate court has upheld a plaintiff’s verdict in an Ethicon transvaginal mesh case, affirming that the claims are not time-barred under Pennsylvania law and the trial court did not err in excluding FDA-created evidence.
However, in the Sept. 20 opinion, the Pennsylvania Superior Court reduced the punitive damages verdict from $17.5 million to $12.5 million in accordance with New Jersey law, lowering the jury’s total verdict to $15 million.
