Former Football Player May Amend Fraud Claims in Nev. Federal Pain Pump Case

RENO, Nev. — A Nevada federal judge has dismissed without prejudice a misrepresentation and fraudulent concealment claim asserted against Stryker and I-Flow in a pain pump action, ruling that the plaintiff must specify which defendant made the alleged misrepresentations.

In an Aug. 30 order, Chief Judge Gloria Navarro of the U.S. District Court for the District of Nevada also dismissed the breach of implied warranty claim for lack of privity, explaining that the plaintiff did not purchase the devices.
