CHICAGO — An Illinois woman who has accused Smith & Nephew and Zimmer Inc. of defectively designing and manufacturing her artificial knee components is urging a federal judge to reinstate her action, arguing that any defects in her second amended complaint can be cured upon amendment.
In a July 25 brief filed before Judge Sharon Coleman of the U.S. District Court for the Northern District of Illinois, plaintiff Barbara Grzanecki argues that amendment will also allow her to add new facts that have come to light since her September 2018 revision surgery.
