Calif. Federal Mentor Silicone Breast Implant Case Dismissed with Prejudice

LOS ANGELES — A California federal judge has dismissed a lawsuit against Mentor Worldwide LLC targeting its silicone breast implants, ruling that the claims are preempted by federal law because plaintiffs failed to plead that the company violated federal standards.

In an Aug. 1 order, Judge Andre Birotte Jr. of the U.S. District Court for the Central District of California also dismissed manufacturer NuSil Technology LLC from the action, ruling that it was fraudulently joined because it did not manufacture any components of the implant.
