Trochanteric Fixation Nail Hip Action to Proceed Against DePuy in Louisiana

NEW ORLEANS — A Louisiana federal judge has refused to dismiss a lawsuit involving DePuy Synthes Inc.’s Trochanteric Fixation Nail hip replacement system, ruling that the claims of defective manufacture and design were adequately pled.

In a July 3 order, Senior Judge Ivan Lemelle of the U.S. District Court for the Eastern District of Louisiana also refused to dismiss the plaintiff’s redhibition claim, noting that the plaintiff does not seek damages for personal injury outside of the Louisiana Products Liability Act.
