Biomet Hip Case Remanded, N.J. Federal Judge Says Seller Defendants Properly Joined

TRENTON, N.J. — A New Jersey federal judge has remanded a Biomet M2a Magnum hip case to state court, ruling that the plaintiffs have asserted colorable claims against the non-diverse seller defendants, destroying diversity jurisdiction.

On June 30, Judge Katharine S. Hayden of the U.S. District Court for the District of New Jersey said the question of whether the seller defendants are immune from liability is not a question that can be addressed at this stage in the case.
