Utah Federal Judge Denies Plaintiffs’ Requests for Discovery in Wright Hip Case

SALT LAKE CITY — A Utah federal judge has refused to order Wright Medical to produce 20 years’ worth of emails in a case targeting its metal-on-metal hip system, ruling that the discovery is not relevant because it relates to conduct not implicated in the action.

In a May 22 order, Chief Magistrate Judge Paul M. Warner of the U.S. District Court for the District of Utah also denied plaintiffs’ request for production of adverse event information concerning a European hip device manufactured by a non-party whom Wright later acquired. The judge found that discovery was also not relevant.
