ALBUQUERQUE, N.M. — A New Mexico federal judge has refused to dismiss a hernia repair patch case, allowing the plaintiff to conduct jurisdictional discovery on whether defendant Maquet Cardiovascular LLC controls the device’s manufacturer, Atrium Medical Corp.

On May 22, Chief Judge William P. Johnson of the U.S. District Court for the District of New Mexico further ruled that the tort claims are not time-barred and are adequately pled.
