Biomet Hip MDL Judge Dismisses Fraud, Misrepresentation Claims with Prejudice

SOUTH BEND, Ind. — The judge overseeing the Biomet M2a multidistrict litigation docket has dismissed with prejudice fraud and misrepresentation claims in 18 cases, after denying plaintiffs’ motion for an extension of time to amend the claims.
In a May 14 order, Judge Robert L. Miller Jr. of the U.S. District Court for the Northern District of Illinois rejected the plaintiffs’ assertion that group case-specific discovery is needed to support their claims. The judge said such information “is something entirely within the knowledge of each plaintiff.”
