Biomet M2a MDL Judge Remands Cases to Transferor Courts

SOUTH BEND, Ind. — The judge overseeing the Biomet M2a Magnum hip multidistrict litigation has suggested that 12 cases be remanded to their transferor jurisdictions, explaining that they will no longer benefit from centralized proceedings.
In the March 28 orders, Judge Robert L. Miller Jr. explained that the remaining case-specific issues in the actions are best left to the transferor courts to decide. He added that no plaintiff has consented to trial of cases in the MDL court. The actions at issue are Draude, Eanes, Whitten, Johnson, Brewer, Burnett, Cottrell, Francis, Honeycutt, Lyon, Summers and McLevis.
