SOUTH BEND, Ind. — An Indiana federal judge has ruled that a tag-along action filed in the Biomet M2a Magnum Hip multidistrict litigation should be transferred to the Western District of Texas, where the plaintiff’s injury manifested and his revision surgery occurred.
In a Jan. 4 order, Judge Robert M. Miller of the U.S. District Court for the Northern District of Indiana rejected the plaintiff’s argument that the Western District of New York, where he underwent implantation of the device, is the more convenient forum.
