MDL Judge Asked to Reconsider Summary Judgment Award in Cook IVC Filter Case

INDIANAPOLIS — A Georgia woman has asked a federal judge to reconsider an award of summary judgment to Cook Medical Inc. in a bellwether case involving its Celect IVC filter, arguing that she provided sufficient evidence that the device maker inadequately warned her surgeon of the risks.
In a Dec. 11 motion filed before Judge Richard L. Young of the U.S. District Court for the Southern District of Indiana, the plaintiff argued that her experts and Cook’s own documents demonstrated that the Celect filter was more likely to cause perforation and fracture than Cook’s Tulip IVC filter.
