ST. LOUIS — A Missouri federal judge has transferred a linear gadolinium-based contrast agent case to the District of New Jersey, ruling that the state has the most significant relationship to the case because the plaintiff’s treatment and alleged injuries occurred in that forum.
In a Dec. 12 order, Judge Charles Shaw of the U.S. District Court for the Eastern District of Missouri further ruled that one of the non-resident defendants lacks sufficient contacts with Missouri because its product is not manufactured there, and its marketing efforts are not targeted specifically at that state.
